I. Terms of Use
Here are the terms and conditions ("Terms and Conditions") for the sale of goods ("Products") by Lepcos ("Lepcos") to Lepcos customers ("Customers"). These "Terms and conditions" below also concern en.ferrite.ru website (the "Site").
By visiting and using the site and Lepcos Services and Materials, you agree to these conditions. Please, read them attentively.
2. Changes to the Terms of Use.
LEPCOS reserves the right to input changes to the terms of these Terms and Conditions without notice. Such changes may concern, but are not limited to, the charges, if any, associated with the access and using of the Site or any part of, including without limitation to the website. You are responsible for reviewing these Terms of Use before logging, shopping, or accessing, visiting, browsing, or interacting or attempting or using any part of the Site or any software, program, or Services on the Site. Your continued use of the Site, its Services, or it's Content after any modification to these Terms of Use acknowledges your agreement to the then Terms of Use.
3. Copyright
The Services and all information presented on this website, Web Services Applications, Software, data, the product database, printed and electronic documentation, content that you see, hear or otherwise experience on the Site. All compilations thereof (the "Content") are protected by international copyright, trademark and other laws, and belong to Lepcos or its partners, affiliates, licensors, suppliers, contributors, or third parties.
Content is protected by copyright laws and international copyright treaties, as well as other laws and conventions related to intellectual property. You also confirm that you don't make attempts to use any robot programs, spider, other automatic devices, or manual process to monitor or copy our Site or the Content contained thereon, to access or capture data, or for any other unauthorized purpose without our prior express written permission of LEPCOS.
4. Authorized Use Of The Site
Registration is necessary to place an order but not essential to use the Site.
Certain functionality on this Site may require the use of an Identification Account. Lepcos represents expanded Tools and Services via the Web through an authorization system, including without limitation, the Web Services Applications and the Services available through Project Sites.
Your username and password are referred to as your "Identification." Your Identification must be accurate, actual, and complete, and you may not provide false information to LEPCOS. You are responsible for saving your Identification confidential. You confirm that you and your authorized representatives will be the only users of your Identification and that you will be solely responsible for all activities on the Site using your Identification. If you guess that someone else uses or has changed your password, please change it so that nobody else can sign in to your account.
5. Order’s Acceptance and cancellation policy.
Each Order formed by the Customer is an offer by Lepcos to purchase Products subject to these Conditions. Any written acknowledgment of receipt of an order shall not, in and of itself, constitute such acceptance. The acceptance of an order shall result in a contract.
All orders are accepted in writing by LEPCOS. It means that LEPCOS takes no Order submitted by the Customer until LEPCOS confirms its written acceptance.
When you place an order via the Site, it will be necessary to provide a valid email address, which we may use to communicate with you. It concerns your order status, a shipment of backordered products, and providing you with any other notices, disclosures or other communications relating to your Order.
In case of cancellation or other withdrawal of an order for any reason, and without limiting any other remedy which LEPCOS may have as a result of such cancellation or additional withdrawal, reasonable cancellation or restocking charges shall include all expenses incurred and commitments made by LEPCOS, and shall be paid by Customer to LEPCOS. Customer requests to reschedule are subject to acceptance by LEPCOS in its sole discretion.
Orders may not be canceled or rescheduled after LEPCOS has submitted the Order to the shipment carrier.
LEPCOS may limit or cancel quantities available for purchase on any order on any basis, and to alter the availability or duration of any special offers at any moment. We may remove any order or any it's part.
If our company rejects to accept your Order, we will do our best to notify you using the email address or other contact information you have provided with your Order. Delivery and (or) shipment dates provided in connection with any order are estimated only and do not represent fixed or guaranteed delivery dates.
The order acceptance is possible in case of subtotal is 300 Euro or more.
6. Return Policy
Returns are commonly accepted when completed within 28 days of the ship date. Returns are accepted in writing by LEPCOS.
If LEPCOS agrees to accept a return, a customer must prepay freight charges. LEPCOS will not accept COD shipments. Some products may require return directly to the manufacturer. All items must be in the original packaging and in resalable condition.
In any case, Please, Contact a sales representative for a Return Materials, Authorization Number, and addressing instructions before returning product.
Only products shipped initially from LEPCOS will be returned to LEPCOS. All others will be promptly quarantined and disposed of or returned to the Customer. By returning products to LEPCOS, the Customer certifies that the Products were purchased from LEPCOS. There has been no substitution in whole or part of the same product from another supplier, distributor, or another such source of the product.
7. Warranty Disclaimer
LEPCOS tries to be as accurate as possible. However, LEPCOS does not warrant that product description or other content presented by LEPCOS is correct, complete, reliable, current, or error-free.
No advice or information offered by LEPCOS, or respective employees shall provide any warranty. Neither LEPCOS warrants that the information or materials on the site will be without interruption or error-free.
8. Payment
All payments must be realized in the currency billed on the original invoice.
The Customer agrees to pay the entire net amount of each invoice from LEPCOS according to the terms of each invoice, without offset. After the order placed, our manager sends you a contract and an invoice for payment. The invoice prices do not include transport fees. The bill can be paid within five business days. All commissions should be debited from the Customer, you require to choose the option “OUR” “FULL PAY” for fees. The next day, shipment will be carried out after receipt of funds to the seller’s bank account.
9. Shipping Charges
Delivery is paid at the customer's expense. Subtotal price does not include a shipping fee.
Products Shipping is being realized only from LEPCOS Warehouse.
For International Shipments: After placing an order, the manager will process your request and contact you to clarify the delivery method. Currently, parcels up to 1000 EUR are sent only by DHL and paid at your expense. You can use your DHL account or pay for delivery at any local DHL office. Parcels over 1000 Euro can be shipped by any courier company in which you have an account. We can also place the transport cost in the invoice and use our DHL account. For an estimated cost of transportation, you can use the delivery calculator on our site. After all details have been agreed on, we will send you an invoice and a contract. The payment is to be transferred only after signing the contract and stamping. We will be able to ship your order the next business day after the payment receiving.
10. Prices
Orders are billed at the prices actual at the time of the invoice issue. Prices will be as specified by LEPCOS and will be applicable for the period specified in Lepcos's quote. The bill can be paid within five business days. Our online catalog reflects the latest pricing information available at the time of printing. Prices shown on the products can be changed without notice. Prices are subject to growth in the event of an increase in LEPCOS's costs or other circumstances beyond LEPCOS's reasonable control. Our prices are given without any taxes, impositions, and additional charges.
LEPCOS pays sufficient attention to the target price policy. In such a case, we offer Project Manager tool, which allows you to plan the requirements and agree upon target prices. In case the subtotal in your cart for one item exceeds 500 euros, you also can share by a target price with us. Target pricing - the price at which a seller projects that a buyer will buy a product.
11. Force majeure
LEPCOS will not take responsibility for a delivery or for failure to realize its obligations due to reasons beyond its reasonable control including, but not limited to, product allocations, material shortages, labor disputes, transportation and plant delays, unforeseen circumstances, acts of God, acts or omissions of other parties, acts or omissions of civil or military authorities, Government priorities, fires, strikes, floods, severe weather conditions, computer interruptions, terrorism, epidemics, quarantine restrictions, riots or war. Lepcos's time for delivery or performance will be extended by the period of such delay or LEPCOS may, at its option, cancel any order or remaining part thereof, without liability by giving a notification to Customer.
12. Limitation of Liabilities
IN NO EVENT SHALL LEPCOS TAKE RESPONSIBILITY FOR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND including, but not limited to, damages resulting from profit loss or revenue, recall costs, claims for service interruptions or failure to supply downtime, testing, installation or removal costs, costs of substitute products, property damage, personal injury, death or legal expenses. Customer's recovery from LEPCOS for any claim shall not exceed the purchase price paid by Customer for the goods, irrespective of the claim's nature, whether in the warrant, contract or otherwise. CUSTOMER SHALL INDEMNIFY, DEFEND AND HOLD MOUSER HARMLESS FROM ANY CLAIMS BROUGHT BY ANY PARTY REGARDING PRODUCTS SUPPLIED BY LEPCOS AND INCORPORATED INTO THE CUSTOMER'S PRODUCT.
13. Trademark
The LEPCOS name and logo and all identical product and service names, design marks, and slogans are trademarks, service marks, or authorized trademarks of LEPCOS. They may not be used in any way without the prior written confirmation of LEPCOS. Other products and service marks are trademarks of their respective owners.
